CONTRACT OF MIAKO-NET USER
1. What is MIAKO-NET?
(1)MIAKO-NET is a nonprofit organization managed by the Sustainable Community Center of Japan(SCCJ).
(2)The term "user" denotes one who agrees with this contract and whose application to be a test user is accepted by MIAKO-NET.
(3)"User information" denotes information registered in the application process.
(4)"Additional information" denotes information which MIAKO-NET considers unrecognizable in terms of user's personal identification and/or necessary information specified in the articles of this contract.
(5)The term "test" denotes a research project for which the MIAKO-NET intends to improve digital communities, with the help of information technology and wireless Internet connection.
(6)"Test area" denotes areas where MIAKO-NET can be accessed. Test areas are specified on our web-site.
2. Actual Use
(1)MIAKO-NET provides users with free internet connection in specific test areas and using a specific IP address.
(2)The MIAKO-NET occasionally provides users with software and devices for the test.
(3)Users can use their own software and devices.
3. User registration
(1)Applicants for the MIAKO-NET Test Users must agree to this contract and register using procedure specified by MIAKO-NET.
(2)Regarding (1), applicants are prohibited to provide MIAKO-NET with false information.
4. Rights and responsibilities of users
(1)Under this contract, a user is considered a participant in a test.
(2)Users participate in the test exclusively in the test areas.
(3)If the user violates this contract, the user's rights yields to MIAKO-NET and MIAKO-NET can take following steps.
A) MIAKO-NET may cancel user's Internet connection.
B) User must return any donated or loaned properties of MIAKO-NET.
C) The user is disqualified for this test.
(4)Users are responsible for properties provided by MIAKO-NET .
(5)The user must immediately report any changes in user information to MIAKO-NET.
(6)The user must respond to test-related questionnaires given by the MIAKO-NET.
(7)Properties provided by the MIAKO-NET must be immediately returned upon the end of the test or in the case of user's disqualification from a test. In this case, user must immediately delete any software provided by MIAKO-NET.
(8)Since this is a test,user must be aware of accept responsibility for any possibility of information leaked out via the wireless and wired areas.
5. Test period
(1)The test period begins 4/1/2002, and ends 12/31/2004.
(2)The test period is subject to change. MIAKO-NET will announce any changes at least one week prio to the date change.
(3)If necessary, MIAKO-NET has the right to interrupt or stop the test without any notice.
6. Change and cancellation of a user's contract
(1)MIAKO-NET has the right to change all or some of the items in the contract at MIAKO-NET's convenience.
(2)If any or all items in the contract change, MIAKO-NET must notify users of the change on the MIAKO-NET website three days before a renewed date starts.
(3)Upon a disagreement with a renewed contract, a user has the right to cancel agreement by reporting to the MIAKO-NET and by following an appropriate procedure.
7. ID and password
(1)MIAKO-NET provides a user with ID and password.
(2)User cannot share password with the public.
(3)ID and password cannot be rented,given or sold to a third party.
(4)No change of ID and/or password is allowed except under terms set by MIAKO-NET.
(5)If password is leaked to a third party, user must immediately report
to MIAKO-NET. Upon report, new ID and password will be given to the user.
8. Users' information
(1)MIAKO-NET has the right to use user's information in MIAKO-NET advertisements,in agreement with the user.
(2)user agrees that MIAKO-NET may share user's information with individuals and companies acknowledged by MIAKO-NET.
(3)The MIAKO-NET has no right to provide a third party with any of user's information, except in the following cases:
A)User agrees with providing his/her information.
B)User is asked by a legal notice to provide his/her information.
C)MIAKO-NET gives reasonable accounts of providing information.
(4)User has a right to request for disclosure of his/her own information. Consequently in case the user finds it incorrect, user has a right to request for correcting and erasing information.
9. MIAKO-NET and User's responsibilities
(1)MIAKO-NET takes no responsibility for damages inccurred during user's participation in this test; nor is the MIAKO-NET responsible for any
compensation regarding the damage.
(2)A user must pay for the damage of properties, in case they suffer the damage on purpose or by serious misuse.
(3)In case a user causes damage to other users or a third party, or in the case of a conflict between the both sides, MIAKO-NET takes no responsibility for the case. With regard to compensation for the damage, the user must be responsible.
(4)MIAKO-NET takes no responsibility for any damages incurred to a user's properties, even after being notified appropriately, based on the grounds that the user has violated rules in the contract.
(5)MIAKO-NET has the right to disqualify a user or his/her membership without any notice in the event that the user violates the rights of other users. This includes but is not limited to damage caused to MIAKO-NET and/or a third party. This also includes damage caused to societyto the society, commits a crimes committed which go against publicity and morality, and does things that the MIAKO-NET and service area providers consider inappropriate.
(6)The MIAKO-NET takes no responsibility for any damages because of inappropriate management of ID and password or of system for input ID and password.
(7)The MIAKO-NET takes no responsibility for interupted or disconnected Internet access.
(8)The MIAKO-NET takes no responsibility if a user cannot participate in the test because of user's model of terminal or operating system.
(9)The MIAKO-NET takes no responsibility for failure of equipment provided by the MIAKO-NET, resulting from user's use.
(10)Upon user's accessing wireless/wired areas, the MIAKO-NET takes no responsibility,for leaked information.
(11)The MIAKO-NET has no responsibility in the event that a user's equipment is damaged because of defective setup or defective operation of the equipment provided by MIAKO-NET.
10. Governing law
Upon this contract, governing law denotes the laws of Japan.
11. Competent court
Upon the test, in the case a lawsuits occurs between a user and the MIAKO-NET, Kyoto local court denotes competent court as first trial.
